Media Bezirgan has obtained the complete official order issued by Madam Justice Jocelyne Gagné on April 24, 2026, in which she granted a temporary stay of Jaskirat Singh Sidhu’s deportation.


Full Court Order Delaying Sidhu’s Deportation Over Suicide Risk Revealed

Sidhu is the truck driver responsible for the 2018 Humboldt Broncos tragedy that killed 16 people and injured 13 others — most of them very young Canadians. He served only 3.5 years of an 8-year prison sentence and has been fighting to remain in Canada.


In his emergency motion, Sidhu asked the court for a stay of removal lasting approximately 17 months, until a first-stage decision is made on his Humanitarian and Compassionate (H&C) application for permanent residence.


The ALJR challenges the Canada Border Services Agency officer’s refusal to defer his deportation. In her reasons, the judge found that Sidhu’s case raises serious issues, including:


  • Whether the CBSA officer properly considered the "overwhelming medical evidence" that Sidhu faces a high risk of suicide (“high suicide lethality”) if removed to India without family support, and

  • Whether the officer properly assessed the best interests of Sidhu’s two Canadian-born children, especially his three-year-old son who has severe heart and lung conditions requiring regular medical attention and the support of both parents.


The judge described the factual background as “an extremely sad series of events” resulting from the 2018 accident and noted Sidhu’s high level of remorse and his diagnoses of severe PTSD and major depressive disorder.
